1. Acceptance of Terms
By downloading, accessing, or using the Herely mobile application ("Herely," "the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Herely provides short, guided meditation content designed to fit into everyday moments and routines. Herely is a wellness tool intended for general relaxation and mindfulness purposes only.
Herely is not a medical device, therapy, or mental health treatment. It is not intended to diagnose, treat, cure, or prevent any medical or psychological condition. If you are experiencing a medical or mental health emergency, contact emergency services or a qualified professional immediately.
3. Eligibility
You must be at least 13 years old to use Herely. By using the App, you represent that you meet this age requirement. Herely is not directed at children under this age, and we do not knowingly collect personal information from children under this age.
4. Safety Notice
Herely's guided content is intended for use only in moments where you are fully in control of your body and surroundings. Do not use Herely while driving, cycling, operating machinery, or in any situation requiring your full attention. You are solely responsible for using the App safely and in appropriate circumstances.
5. User Accounts
If Herely requires an account, you agree to provide accurate information (such as your name, email, and phone number) and to keep this information current. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, copy, or redistribute the App's content or code
- Interfere with or disrupt the App's functionality or servers
- Use the App in a way that could harm Herely, other users, or third parties
7. Intellectual Property
All content, design, audio, branding, and code within Herely are the property of One Clew LLC unless otherwise stated. You may not copy, modify, distribute, or create derivative works from Herely's content without written permission.
8. Subscription & Payment
Herely is $3.99 per month, or $39.99 per year (billed once a year, equivalent to two months free). New subscribers get a 7-day free trial before the first charge. Promotional or ambassador codes may offer different pricing or trial terms. Subscriptions are billed and managed through your Apple or Google account and renew automatically until cancelled. You can cancel anytime from your phone's subscription settings, accessible via a link in your Profile. All purchases are final and non-refundable, except where the App fails to work as intended, in which case contact us and we will make it right.
9. Termination
We reserve the right to suspend or terminate your access to Herely at our discretion, including for violation of these Terms. You may stop using the App and delete your account at any time.
10. Disclaimers & Limitation of Liability
Herely is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, One Clew LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the App.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated through the App.
12. Governing Law
These Terms are governed by the laws of the State of California, USA.
